BETA TERMS OF SERVICE
PeddleNet — community test (Tier C)
These Beta Terms of Service (the "Terms") govern your use of the PeddleNet beta application and mesh network (the "Service"), operated by Bill Costello / Qvintessential Design ("we," "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the beta. By using the Service you confirm that you are.
2. The beta is experimental
This is pre-release software provided for testing. It may be unreliable, may lose or delay messages, and may change or stop at any time. It is provided for evaluation, not for critical use.
3. Not for emergencies
THE SERVICE IS NOT A SUBSTITUTE FOR CELLULAR SERVICE OR EMERGENCY SERVICES. DO NOT RELY ON IT TO CONTACT 911 / 112 OR ANY EMERGENCY RESPONDER. In an emergency, use a phone's native emergency calling or find a steward/marshal.
4. Licence and restrictions
We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for the test. You agree not to: reverse-engineer, decompile, or attempt to derive the source code or protocols; interfere with, overload, or disrupt the mesh; impersonate others or spoof identities, presence, or location; or attempt to intercept, read, or tamper with other users' traffic.
5. Your content and how the mesh carries it
You own the messages you create. You grant us and the network a licence to transmit, relay, store-and-forward, and display your messages as needed to operate the Service.
Messages travel peer-to-peer across other users' devices, outposts and peddlers. In the beta there is no server: your messages are not uploaded to us, are not queued on our systems, and we cannot retrieve or restore them. There is no real-time human moderation.
You are responsible for what you send; do not send unlawful, harassing, or infringing content.
6. "Secret" / code-gated rooms are not encrypted
Some rooms are private in the sense that they require a code to join. This is an access gate, NOT end-to-end encryption. Message contents are signed for authenticity but are not encrypted end-to-end in the beta. Do not send confidential or sensitive information through the Service.
7. Location-based and event features
Some features may use approximate proximity to fixed anchors. If any activity directs you to move within a venue, follow all venue rules, staff instructions, and posted safety guidance; move safely and at your own risk.
8. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST, DELAYED, OR UNDELIVERED MESSAGES. Our total liability is limited to the amount you have paid us for the Service, which is zero. Some jurisdictions do not allow certain limits, which may not apply to you.
10. Feedback
If you give us feedback, you grant us a free, perpetual licence to use it to improve the Service, with no obligation to you.
11. Privacy
Your use is also governed by our Privacy Notice, which explains what data we process and your rights.
12. Changes, termination, governing law
We may update these Terms or end the beta at any time. Continued use after an update means you accept it. These Terms are governed by the laws of the State of Colorado, United States, subject to any mandatory consumer-protection rights in your country of residence.
